The Supreme Court on Monday rejected a plea by a Sri Lankan Tamil national, Subaskaran, who was seeking refugee in India. The court observed that the India is not a Dharamshala that can entertain refugees from all over the world. this decision was made while listening Subaskaran's petition challenging a Madras high court orders directing him to leave India immediately after serving a seven year sentence under the unlawful activities under Prevention Act, 1967.

• Subaskaran's Background: He was arrested in 2015, in the case of being involved in a conspiracy theory to revive the liberation Tigers of Tamil Eelam (LTTE), a banned militant group in Sri Lanka.
• Supreme Court's Observation: Justice Dipankar Datta stated that, India is to host refugees from all over the world? we are already struggling with a huge population of 140 crore. This is not a Dharamshala where we can entertain foreigner of all countries and from everywhere.
• Court's Decision: The bench also comprising Justice Chandran, refused refused to entertain Subaskaran's plea, stating that if his life is truly in danger in Sri Lanka and requested if he gets the permit to stay in India.
• Petitioner's Claim: Subaskaran's counsel argued that he would face torture if he gets back to Sri Lanka and he requested that let him live in India, in refugee camp.
